The legal filing asserts that Harwood manipulated the chatbot to transform non-sexual photographs into explicit content without consent. xAI claims these actions directly breached its service policies and exposed the firm to substantial legal and reputational harm. The company is seeking financial damages from the defendant to cover costs associated with defending itself against potential litigation from victims of his conduct.
xAI files lawsuit against user over Grok-generated CSAM
Terry Wayne Harwood, a South Carolina man currently facing eight felony charges for possessing and distributing child sexual abuse material, is now the target of a federal lawsuit from xAI. The company alleges Harwood deliberately bypassed Grok’s safety protocols to produce and disseminate illicit deepfake imagery of minors.

This marks a shift for Elon Musk’s AI venture, which previously faced a March lawsuit from a group of teens who alleged the platform generated sexualized images of them. While Musk has publicly warned that users creating illegal content would face severe consequences, this action represents the first time the company has taken a user to court over the misuse of its image-generation tools. Harwood remains in custody following his February arrest, as authorities continue to investigate the extent to which Grok was weaponized to facilitate his alleged crimes.
