According to the filing, the company failed to disclose that it was considered a Chinese military entity under the National Defense Authorization Act, a designation that triggered a 3.9% drop in share price following the U.S. Department of Defense's official announcement on June 8, 2026.
Alibaba Faces Securities Fraud Lawsuit Over AI Ties and Military Links
Investors who suffered losses during Alibaba’s recent market downturn are being urged to join a class action lawsuit, Wistisen v. Alibaba Group Holding Limited. The legal action, filed in the Southern District of New York, targets the company’s alleged failure to disclose critical regulatory risks and illicit AI development practices.

Further allegations suggest that Alibaba engaged in industrial espionage by using thousands of fake accounts to access Anthropic’s Claude AI models. The lawsuit contends that the company utilized these accounts to execute unauthorized distillation attacks to train its own proprietary AI, a disclosure that caused shares to slide an additional 4.7% in late June. Reed Kathrein, the Hagens Berman partner heading the investigation, stated that the firm is looking into whether these actions were part of a deliberate effort to mask the company's true risk profile. Investors have until October 5, 2026, to apply for lead plaintiff status in the ongoing litigation.
