Thrive Care Services Faces Class Action Over Alleged Wage Theft

A new class action lawsuit filed in San Diego County Superior Court accuses Thrive Care Services LLC of systemic labor violations, including failing to pay employees for off-the-clock work and denying legally mandated rest periods, potentially affecting a broad group of the company’s staff.

Thrive Care Services Faces Class Action Over Alleged Wage Theft

The complaint, registered under case number 26CU043450C, alleges that the firm consistently failed to track actual hours worked, depriving employees of proper compensation. Attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP claim the company also neglected to provide required meal and rest breaks. According to the filing, shifts lasting between six and eight hours frequently lacked the mandatory two ten-minute rest periods, while longer shifts often bypassed a third break entirely.

Beyond rest periods, the litigation targets the company’s sick pay and expense reimbursement policies. The lawsuit alleges that Thrive Care Services paid sick leave at a base rate rather than the regular rate of pay, violating California Labor Code sections 246 and 2802. Furthermore, the firm is accused of failing to indemnify employees for business-related expenses incurred during their duties. The plaintiffs are now seeking legal recourse to recover unpaid wages and address these alleged labor code breaches.
