The litigation centers on claims that Bloom Energy misrepresented the independence of its supply chain. While the company publicly maintained that its operations were not dependent on China, the complaint alleges that the firm utilized intermediaries to procure scandium—a critical rare earth metal used in its solid oxide fuel cell systems—directly from Chinese sources. The lawsuit contends that Bloom Energy understated this dependency, rendering its public statements regarding business prospects materially misleading.

Market volatility followed the publication of a report by Hunterbrook Media titled "Bloom's Big Lie." The investigation claimed to identify four distinct trade routes showing that Chinese scandium reached the United States through intermediary nations. According to the report, trade data and statements from a major Chinese producer indicated that Bloom Energy received material directly from China on four separate occasions between August 2023 and May 2024. Following these revelations, Bloom Energy stock fell $15.28 per share, a 5.7% decline, closing at $254.29 on July 8, 2026.
