Amazon settles FTC Prime lawsuit for $2.5 billion

A federal jury trial in Seattle ended abruptly this week as Amazon agreed to a $2.5 billion settlement with the Federal Trade Commission. The deal resolves allegations that the e-commerce giant utilized deceptive digital design patterns to trap millions of unsuspecting shoppers into recurring Prime subscriptions while complicating the cancellation process.

Under the terms of the agreement, Amazon will pay a $1 billion civil penalty alongside $1.5 billion in direct refunds to approximately 35 million impacted customers. The FTC originally filed the suit in 2023, arguing that company executives knowingly implemented "dark patterns" to manipulate users. The agency highlighted a specific practice where customers were forced to navigate a confusing maze of pages just to opt out of the service.

The settlement mandates significant changes to Amazon’s interface. The company must now provide a clear, conspicuous button for users to decline Prime membership, effectively banning the use of misleading language like "No, I don't want Free Shipping" as a substitute for a direct decline option. Furthermore, the cancellation process must be streamlined to mirror the ease of the sign-up flow, prohibiting the company from imposing costly or time-consuming hurdles. Amazon must also provide explicit, transparent disclosures regarding renewal policies and total costs during the enrollment phase. While the company maintains that its executives followed the law, the settlement requires a complete overhaul of its subscription architecture to ensure consumer choice remains front and center.
