The legal battle centered on Parse’s Evercode Whole Transcriptome product line, which the court found utilized proprietary technology without authorization between February 2021 and mid-2026. Beyond the initial financial penalty, which reflects a 14% royalty rate on infringing sales, 10x Genomics intends to pursue further remedies. The company is seeking enhanced damages, coverage for legal fees, and a permanent injunction to block Parse from selling the contested products within the United States.
Jury Rules Parse Biosciences Willfully Infringed 10x Genomics Patents
A Delaware jury has ordered Parse Biosciences, now a subsidiary of Qiagen, to pay $4.8 million in damages for the willful infringement of single-cell analysis patents. The verdict, delivered August 28, 2026, validates three core patents exclusively licensed to Scale Biosciences, a company acquired by 10x Genomics last year.

Randy Wu, General Counsel for 10x Genomics, characterized the jury’s decision as a definitive rejection of Parse’s defense strategy. He argued that the evidence demonstrated a calculated decision by Parse to bypass the inventions of Dr. Garry Nolan, a co-founder of Scale Biosciences. For 10x Genomics, the ruling serves as a broader signal regarding the protection of intellectual property in the biotechnology sector, reinforcing the value of foundational research in single-cell and spatial biology.
