The lawsuit, spearheaded by the Rosen Law Firm, claims that Datavault AI misled shareholders by inflating the economic value of partnerships with firms such as Burke, Scilex, and Nature's Miracle. Furthermore, the complaint alleges that the company misrepresented the volume of activity on its platform, which plaintiffs contend was minimal. The suit also highlights undisclosed connections between Datavault and Edward Withrow III, a convicted felon, claiming this association caused significant reputational damage when it eventually came to light.

Investors seeking to participate in the class action do not need to pay out-of-pocket fees, as the case operates on a contingency basis. While the court has not yet certified a class, those who purchased the stock during the specified period may move to serve as lead plaintiff. This role involves representing the interests of other class members in directing the litigation. Those choosing not to take an active role may remain absent class members, as potential future recovery is not contingent upon serving as a lead plaintiff.
