Closing the Liability Gap: Insurance Lessons for Long Island Contractors

Many Long Island contractors treat insurance as an afterthought, only discovering critical coverage gaps after property damage or workplace injuries trigger legal claims. Garden City insurance expert Paul Bernieri warns that relying on standard policies without verifying exclusions for subcontractors and equipment can leave construction firms financially vulnerable.

Closing the Liability Gap: Insurance Lessons for Long Island Contractors

General liability insurance is frequently misunderstood as a catch-all safety net. In practice, policies are riddled with specific limitations regarding property damage and bodily injury claims. Bernieri emphasizes that the most common oversight involves subcontractor work; many standard policies fail to extend protection to specialized trades like roofing or plumbing unless explicitly defined. This leaves prime contractors exposed to the legal fallout of a subcontractor's error.

Beyond basic liability, equipment coverage and completed operations are often neglected. General liability policies rarely cover stolen power tools or damaged machinery, necessitating separate protection for high-value gear. Furthermore, issues such as structural defects or water leaks often emerge months after a project concludes. Without active completed operations coverage, contractors remain liable for these delayed claims long after they have left the site.

Contractors are urged to move beyond passive coverage and conduct regular policy audits, especially when scaling operations or taking on larger projects. Failing to update insurers on headcount changes or new service areas creates significant coverage voids. By maintaining strict job site safety standards and verifying that all subcontractors carry their own active, documented insurance, business owners can mitigate risks before a claim forces an expensive realization.
