Agents detained Tunick, a figure linked to the Stop Cop City movement, under the suspicion of possessing illicit imagery. His legal team argues this served as a cover for a fishing expedition into his political associations. Central to the government’s case is a rare statute prohibiting the damage of property to prevent seizure. Prosecutors allege Tunick utilized a GrapheneOS feature to trigger a factory reset by providing a false passcode during the inspection.

The defense maintains the entire encounter was unlawful, citing a lack of a warrant, the denial of counsel, and a failure to inform the traveler of his constitutional rights. Federal officials argue the standard rules for search and seizure do not apply in this instance because Tunick had not yet been formally granted entry into the country. Marlon Kautz of the Atlanta Solidarity Fund characterized the prosecution as an assault on the right to digital privacy, noting that citizens increasingly face prolonged detentions and invasive scrutiny at the border.
